Notice of the Ministry of Culture on Adjusting the Implementation of the Policies for Wholly Foreign-Owned Performance Brokerage Agencies in Specific Areas of Beijing Municipality

The Beijing Municipal Bureau of Culture:

In order to effectively implement the Official Reply of the State Council on the Overall Plan for the Comprehensive Pilot Program of Expanding the Opening-up of the Service Sector in Beijing (Letter No. 81 [2015], State Council), the Decision of the State Council on Temporarily Adjusting the Relevant Administrative Approval Items and Special Market-Access Management Measures in Beijing (No. 60 [2015], State Council) and other relevant provisions, the relevant policies for the administration of the cultural market in Beijing Municipality are adjusted as follows:

I . Foreign investors are allowed to form wholly foreign-owned performance brokerage agencies within four specific areas including National Service Industry Comprehensive Reform Pilot Zone of Shijingshan District in Beijing Municipality, Cultural Bonded Park of Tianzhu Free Trade Zone, National Cultural Industry Innovation Experimental Zone of Chaoyang District, and "China Music Valley" Park of Pinggu District, so as to provide services within the scope of Beijing Municipality. The time limit for the matters adjusted shall be available by May 5, 2018.

 II . Anyone who intends to form a performance brokerage agency in the form of a Chinese-foreign equity joint venture, a Chinese-foreign contractual joint venture, or a wholly foreign-owned enterprise in any specific area of Beijing Municipality shall, after receiving the business license issued by the administrative department for industry and commerce, file an application with the Beijing Municipal Bureau of Culture. The Beijing Municipal Bureau of Culture shall make a decision within 20 days as of receipt of the application.

A performance brokerage agency in the form of a Chinese-foreign equity joint venture, a Chinese-foreign contractual joint venture that plans to hold commercial performance activities in Beijing shall file an application with the competent culture department at the place where the performance is to be held. Anyone who plans to hold a commercial performance participated by a domestic cultural and artistic performance group or performers shall file an application with the competent culture department of the people's government at the county level, which shall make a decision within three days as of acceptance of the application; and anyone who plans to hold a commercial performance involving any foreign country or Hong Kong, Macao or Taiwan shall file an application with the competent culture department of the provincial people's government, which shall make a decision within 20 days as of acceptance of the application.

III . The matters on the administration of the cultural market adjusted in this Notice shall apply to investors in the Taiwan Region that invest in and form enterprises in specific areas of Beijing Municipality and the Chinese citizens domiciled abroad.
