Key Tasks of Improving Business Environment in the New Round of Reforms to Delegate Power, Streamline Administration and Optimize Government Services of Beijing
This document is formulated in order to thoroughly follow the important instructions of president Xi Jinping that Beijing and other megacities should take the lead in stepping up the reform of the business environment, and implement the strategic plans made by the Party Central Committee and the State Council to deepen the reforms to delegate power, streamline administration and optimize government services. The goal is to steadfastly promote the reform of the business environment, further transform the government functions, improve its service efficiency, stimulate the vitality of market players, and promotes the high-quality development of the capital.
I. Objectives
We should earnestly implement the instruction made on the National Conference on Deepening the Reforms to Delegate Power, Streamline Administration and Optimize Government Services and Optimizing Business Environment held by the State Council, establish the goal of effectively enhancing the sense of gain for enterprises and the masses, free our minds from old ideas, be steadfast in exploring and innovating, so as to make vigorous efforts in the new round of the reform. We should firmly perform the key tasks in the further optimizing business environment action plan, benchmark to the world-class and best domestic role models, strive for the national reform to be piloted in Beijing, and make new breakthroughs in key indicators, key links and major difficulties. We should vigorously promote the "Internet+ Government Services", aiming for new breakthroughs in "unified online government service ". We should constantly improve government services, aiming for new breakthroughs in the construction of comprehensive windows. We should make efforts to improve the convenient services for the enterprises and the masses, aiming for new breakthroughs in the "four reductions and one increase" (reducing links, reducing materials, reducing time limits, reducing costs, and increasing policy transparency). We should further improve the effectiveness of credit management and comprehensive law enforcement, aiming for new breakthroughs in operational and post-operational oversight. We should promote smart application scenarios of new technologies such as big data, artificial intelligence, blockchain and 5G, aiming for new breakthroughs in government affairs technology. We should uphold that the rule of law facilitates the best business environment, aiming for new breakthroughs in the guarantee of the rule of law, and striving to maintain the leading position of the city in terms of business environment in the country, thus making greater contributions to China's creation of a world-class business environment.
II. Main Tasks
To better implement the national tasks of deepening the reform of "simplification of administrative procedures, decentralization of powers, combination of decentralization with appropriate control, and optimization of services", we should focus on key areas such as enterprise innovation and entrepreneurship, investment and trade, market competition, and legal protection, formulate a list of reform tasks, identify responsibilities and time limits, and effectively solve the pain points, difficulties and obstacles the enterprises and masses face. The tasks involved are as follows:
(1) Further deepening the reform of the commercial system. We should deepen reform with the focus on the key links of enterprise start-up, change, and cancellation. The "e-window" platform should be improved, so that corporate legal persons can handle tax, social security, provident fund and other matters on the platform. The enterprise cancellation system should be merged with the "e-window" platform to expand the scope of data sharing among the authorities and realize the "unified online government service" for the establishment and cancellation of enterprises. We should promote the online service of enterprise changes, the tolerance and conditional pass with written promise system (i.e. if some application documents are incomplete but the applicant promises in writing the provision of such documents within a prescribed time limit, such application shall be accepted to accelerate the handling process). We should also increase publicity and training efforts, increase the use of "full-process online service" for enterprise change registration. We will improve the enterprise registration tolerance mechanism, expand its coverage, and launch a pilot in Fengtai District. We will promote the blockchain pilot in Haidian District, realize the automatic verification of the registered address and business scope of the enterprise, and improve the efficiency of establishing enterprises. We will continue to promote the reform of "separation of operating permits and business licenses" and reduce the number of industrial production licenses by more than half.
(2) Deepening the reform of the approval system for construction projects. We should focus on the "three streamlining" (streamlining steps, time, and costs), and promote the reform of the whole-process and full-coverage approval for construction projects. A municipal-level reform team will be established to deeply analyze and study the problems and reform directions of the city's engineering construction project approval system, accelerate the reform of the approval process centered on the conditional pass with written promise system for enterprise investment projects, and further improve the approval process and "One Stop" system for simple and low-risk projects. We should actively promote the construction of "one blueprint, one system, one window" mechanism, benchmark to international forerunners, actively promote the sharing of the "one blueprint" under "Multi-planning Integration" platform among authorities, and provide inquiry channels for investment entities. We will establish an approval system featured "unified declaration, parallel approval, and unified online government service" with the online approval and supervision platform for investment projects as the main body, and further improve the comprehensive windows for constructions permits. We should improve the project safety and quality risk matrix system, introduce a management and control system for various risk levels, and determine the inspection frequency and content accordingly.
(3) Optimizing access services for utilities. We should further improve the "three zero" (zero on-site, zero review, zero investment) service, optimize the approval process, and improve the efficiency and reliability of utility access. Measures for parallel approval of access to utilities should be introduced to promote parallel approval of authorities, such as planning of natural resources, housing and urban and rural construction, public security and traffic management, and landscaping sector, to simplify materials and facilitate information sharing. We should gradually expand the coverage and target groups of the "three zero" service for water and gas, and achieve "no visit" to the authorities for small and micro gas projects and "one visit only" to the authorities for other gas projects through online application, door-to-door visits by officers, full-process agent service. We should vigorously promote the mobile APPs, through WeChat applet, Alipay, Baidu, Beijingtong APP and other channels, to achieve reporting, application, inquiry, payment and other services on mobile terminals for water, electricity, gas, heat, and telecommunications, continuously improving the convenient services. We should connect the power reporting system with the municipal service resource sharing platform, establish a data and license sharing mechanism, and shorten the processing time. We should cooperate with the competent authorities to promote the revision of relevant laws and regulations, establish a power shutdown punishment mechanism for enterprises, and urge enterprises to further improve power supply reliability.
(4) Promoting intelligent handling of real estate registration. Using real estate registration as a model, we should further promote the application of new technology and realize the interconnection and sharing of information in the government. We should promote the "unified online government service" in an all-round way, and explore online application and online tax payment for all business types such as enterprise real estate registration, change, and Judicial seizure. We should carry out the pilot of electronic licenses for real estate registration, and promote the integration of the real estate registration system with utility information systems such as water, electricity, gas, and cable television to achieve synchronous transfer. We should establish a real estate registration center on mobile terminals, achieve 24/7 service using big data, face recognition, online payment and other technical means. We should promote the application of blockchain to achieve information sharing applications such as household registration, business licenses, ownership surveying and mapping, judicial decisions, etc., and promote the pilot of real estate registration "via one certificate", "accessible across the city" and "instant and smart approval".
(5) Further improving trade facilitation. We should further reduce the time and cost of cross-border trade, and continue to optimize customs clearance services. We should strive to pilot the national "two-step declaration (i.e. preliminary declaration and complete declaration)" reform in Beijing, and implement the import declaration mode based on the system. Enterprises are allowed to declare and deliver goods with the summary of the bill of lading only, and then complete the information later, so as to further improve customs clearance efficiency. We should build "Single Window" 2.0, build a comprehensive public service platform for logistics information, and implement "integration of multiple platforms". We should promote the reform measures for advance declaration of airport imports, improve the advance declaration fault-tolerance mechanism, facilitate more enterprises to conduct advance declaration, and further reduce the clearance time needed. We should further promote the reform of diversified tax guarantee methods, expand the pilot scope of customhouse bonds insurance, increase the aggregate tax rate and the proportion of self-declared and self-paid tax, consolidate and improve the guarantee-free release model, so as to guide and help enterprises to make better use of the reform policies.
(6) Further improving the financing and tax environment. We should focus on solving the issues of difficult, expensive, and slow financing for private, small and micro enterprises (SMEs). A comprehensive financial service platform for SMEs should be established, which uses financial technology to establish financial credit information files for them, and build an information service system that focuses on corporate financial credit. We should establish an enterprise loan renewal acceptance center and a green channel to provide private enterprises with first loan consultation, loan renewal approval and other investment and financing services. The real estate registration service will be extended to bank outlets, and "real estate comprehensive service window" in banks will be set up, which allows customers to directly apply for real estate mortgage registration, while applying for loans. 200 service stations of this kind had been established by the end of 2019 to achieve full coverage of all districts and major banks. We should further reduce the tax payment time and improve the convenient services of tax payment for enterprises. We should update and release the second batch of tax handling items of "one visit only", "no visit" and the list of services "accessible across the city". We should actively cooperate with the State Administration of Taxation to implement the combined declaration of urban land use tax and real estate tax to reduce the number of tax items.
(7) Strengthening the legal protection of the business environment. We should actively assist in accelerating the revision of the Company Law and Enterprise Bankruptcy Law and other related laws at the national level, promote the judicial practices in this regard in Beijing, and establish a set of typical cases. We should promote the Beijing Regulations on Promoting the Transformation of Scientific and Technological Achievements and Beijing Regulations on Optimizing the Business Environment and other related legislative work. We should actively facilitate the inclusion of all bankruptcy cases in the city into the coverage of Beijing Bankruptcy Court, standardize the handling of bankruptcy, and increase the success rate of bankruptcy reorganization. We should actively promote the electronic delivery of court summons, evidence materials, etc., improve and standardize the enterprise delivery address database, and strive to cover the whole city.
(8) Deepening bidding and tendering reforms. We should strengthen the management of the full-process management and supervision of government procurement, and promote the full-process electronic handling of bidding. According to the World Bank methodology, on the basis of the existing bidding and tendering management methods, we will formulate Administrative Measures for Highway Maintenance Project to achieve full-process procurement management. We should integrate with the government procurement management system of each district, and facilitate the data sharing between the districts and the city. We should promote the bidding and tendering in transportation, survey and design and other fields to be included in Beijing's public resource trading system, realize the full-process electronic handling required by the state, and achieve full coverage of all industries at all levels. The public entrances and digital authentication services of the Beijing public resource transaction service platform and its various sub-platforms should be unified to achieve "services via one certificate".
(9) Facilitating the creation and protection of intellectual property rights. We should strengthen the protection of intellectual property rights of enterprises, and further improve the quantity and quality of enterprise patent applications. We should study and formulate the Beijing Municipal Administrative Measures for Intellectual Property Fund, establish a municipal data sharing mechanism for administrative law enforcement and judicial trials in the field of intellectual property, and strengthen the mediation of disputes in the high-end, precision and sophisticated industries in Beijing. We should promote the construction of demonstration zones for intellectual property concentration and development of small and medium-sized enterprises, build an intellectual property public service system with capital characteristics, carry out patent creation training and services, promote the establishment of an "intellectual property steward" system, and provide customized intellectual property programs for small, medium and micro enterprises. We should continue to explore and promote the patent pledge financing insurance in Zhongguancun, and accelerate its application in the Zhongguancun National Innovation Demonstration Park.
(10) Significantly improving government services. We should continue to advance the "one website, one window, one door, one visit" reform, break data barriers, formulate service standards, and improve the efficiency and quality of window services. We should accelerate the sharing of government service data, promote the integration of government service platforms at the city and district levels, and promote unified identity authentication; carry out pilot applications of government service intelligent scenarios; comprehensively promote the application of electronic seals in the government service field in various districts and authorities; accelerate the implementation of the Fingertip Action Plan and enrich the business channels for the masses and enterprises using government service APP, self-service machines, and applets; promote the pilot "unified online government service" in Beijing, Tianjin and Hebei. We should vigorously promote "instant handling, nearby handling, handling with one visit only, cross-district handling", achieve "no visit" or "one visit only" for 600 frequent government service items for both the city and the districts, respectively, and reduce the average number of visits to below 0.3. We should promote the "four reductions and one increase" reform, achieve a 60% reduction in materials required in all districts and authorities, and reduce the time limit for administrative licensing matters to within 45% of the legal time limit. We should promote the standardization of government services at the city, district, street (township), and community (village) levels. We should reasonably refine the quantified approval service standards, promote the indiscriminate handling for the same items based on the same standards, achieve "nearby handling, cross-district handling, handling across the city" for more items, and formulate Government Services Guideline 3.0 for each district and authorities.
(11) Conducting fair and prudent market supervision. We should integrate supervision resources, improve supervision efficiency, and strengthen the credit system. We should accelerate the reform of the comprehensive law enforcement system and coordinate administrative law enforcement functions and allocate law enforcement resources in the fields of market supervision, environmental protection, cultural markets, transportation, agriculture etc. We should promote inter-departmental and cross-regional joint supervision, joint rewards and punishments, accelerate the construction of a dual-random platform for market supervision departments, complete the integration of the entire process within the market supervision department, and achieve "Dual Random, One Open" coverage of departments involved in the market supervision field. We should establish and improve the credit archives of 14 key groups of people, establish enterprise credit risk classification indexes, and explore differentiated, inclusive and prudential supervision. We should further improve the blacklist exit mechanism and formulate a credit repair policy for dishonesty punishment records. We should speed up the development of the unified city-wide credit information collection and classification management standards, improve the functions of the public credit information platform, and integrate the "Internet + supervision" system with the "Dual Random, One Open" system, "Market Supervision Risk Insight Platform", "Credit Beijing", so as to achieve data aggregation, intelligent analysis, accurate monitoring, and joint punishment.
(12) Creating an inclusive environment for innovation. With the focus on science and technology innovation, talent flow, employment services, market access, public services and other fields, a number of policies will be issued to promote the reforms to delegate power, streamline administration and optimize government services. Taking the opportunity of the new opening-up pilot projects in the service industry, we will continue to improve the international development of education, culture and tourism, health care, and old-age care. The reform of overseas investment filing will be implemented, and the management model of "filling with one form only, information sharing, and parallel approval" will be explored to provide convenience for enterprises to "go global". We should simplify the access procedures for the medical market, introduce the clinic record management measures in Beijing, switch from the approval system to the record system for the establishment of clinics, reduce the cost of nongovernmental hospitals to spur their blossoming.
III. Supporting Measures
(1) Improving the Promotion Mechanism for the Business Environment Reform
We will set up the Business Environment Branch under Beijing Municipal Government Coordination Team for Government Function Transformation and Reforms to "Delegate Power, Streamline Administration And Optimize Government Services", which will coordinate and promote the city's business environment reform and evaluation. It will be led by the head of Beijing Municipal Commission of Development and Reform, and its deputy leaders will be chosen from the municipal departments concerned. It covers 56 departments and 16 districts involved in the issue of business environment as member units, and has the goal of constantly improving the implementation mechanism of coordination and promotion at both the district and city levels.
(2) Establishing a Normalized Suggestion Mechanism to Improve the Business Environment
In the formulation of policies to optimize the business environment reform, we will further give play to market and social initiative, and listen to the opinions and suggestions of all sectors of society through a variety of channels and methods. We will pay attention to the roles of industry associations, entrepreneurs, and professionals, establish a social consultation mechanism in Beijing, collect the needs of the people, consult with the people, and gather the wisdom and power of the people, so as to enhance the relevance and effectiveness of the reform.
(3) Further Strengthening Fundamental Works
Districts, departments, and agencies concerned should continue to carry out policy and business training, improve the service awareness and ability of window staff, and effectively solve the "last mile" problem of policy implementation. It is necessary to intensify the application of science and technology for more convenient and efficient business management. We should also establish a reporting mechanism for key business environment reform indicators, continue to carry out special inspections, identify problems and rectify them in a timely manner, and ensure that all reform tasks are fully implemented.
(4) Scaling Up Publicity Efforts in a Wide and Constant Manner
We should formulate a citywide publicity plan for the business environment reform, which provides multi-channel, multi-form, multi-level comprehensive interpretation of the various reform policies, so that more enterprise and people know the changes and enjoy dividends brought by the reform. In addition, international publicity efforts should be increased to attract high-level international resources to Beijing.
