How do foreign-invested enterprises comply with the Special Administrative Measures (Negative List) for Foreign Investment Access?

2025-09-19 19:28

The registration authority conducts a formal review of the relevant application documents. Sectors invested by foreign investors or foreign-invested enterprises not covered in the Negative List shall be subject to administration in accordance with the principle of equal treatment for domestic and foreign investments. For investments in sectors within the Negative List that have restrictions on the proportion of capital contribution, the nationality of the legal representative (or principal responsible person), and other conditions, registration will be allowed if the investment meets the conditions set by the Special Administrative Measures. Where the industry authority has already approved the relevant enterprise-involved business permits by law before registration, the registration authority does not need to conduct a duplicate review of the compliance with the Special Administrative Measures. Investments in the sectors prohibited by the Negative List will not be registered.
