Beijing Regulates "House Leasing" Through Legislation and Here Are Ten Highlights

On November 24th, the Regulations of Beijing Municipality on House Rentals  (Draft) was deliberated on the 35th Session of the Standing Committee of the 15th Beijing Municipal People's Congress. This legislation focuses on regulating the house leasing market. The following aspects deserve your attention:

1. Encourage the signing of long-term contracts. Tenants have the rights to enjoy the same property services as landlords;

2. Price-intervention measures shall be taken when rental prices rise significantly;

3. The agencies that rent out "formaldehyde rooms" with poor indoor air quality will face administrative punishment;

4. Rooms shall not be divided to get more renters into a single room. Living rooms shall not be rented out alone;

5. When renting out an apartment by the hour or the day, the owner shall comply with relevant regulations or obtain the consent of other landlordsin the same building (yard);

6. Housesor apartments shall not be rented to individuals who do not show their identification cards while renting;

7. Generally, deposit collected from tenants shall be no more than one month's rent;

8. Individuals shall set up a house leasing company if the number of houses they sublet exceeds the prescribed amount;

9. Subdistrict offices and township governments shall conduct daily supervision over house leasing within their jurisdiction;

10. The amount of "rental loan" shall not exceed the rent specified in house leasing agreements.
